1. Provider

The service is provided by Mehmet Arici, Weilertalstr. 20, 72172 Sulz am Neckar, Germany ("we", "us"). Contact: akademai@outlook.de.

2. The service

NovelWriterAI is an online tool that helps you plan, write, continue, and export serialized fiction using artificial intelligence. Output is generated by AI models and may contain errors, inaccuracies, or content that does not meet your expectations. The service is provided on an ongoing basis and may evolve over time.

3. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the service. You are responsible for the accuracy of your registration details, for keeping your credentials confidential, and for all activity under your account. Notify us immediately of any unauthorised use.

4. Plans, billing, and founding pricing

• Free plan: we may offer a free plan with limited usage. We may change or discontinue the free plan in the future; any such change will not retroactively affect a paid subscription you have already purchased.
• Paid subscriptions: paid plans are billed in advance on a recurring basis (for example, monthly) at the price shown at checkout, which includes VAT where applicable. Each plan includes a monthly chapter allowance and new-book credits (one with Starter, two with Author, three with Pro); additional chapters may be purchased as described at checkout.
• Founding pricing: if a founding or early-access price is offered and you subscribe during that period, we will honour that price for your continuous subscription as described in the offer.
• Renewal: subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time as described in our Cancellation and Refunds page.
• Price changes: we may change prices for future billing periods with reasonable advance notice. Continued use after the change takes effect constitutes acceptance.
• Payments: payments are processed by our payment provider. You authorise us and our provider to charge your payment method for the amounts due.
• 14-day money-back guarantee. On a new paid subscription you may request a refund within 14 days. To claim it, email us within that period with the reason the product did not meet your expectations. The guarantee ends early, whichever happens first, when you start a second book or when you download or export a book, in order to prevent abuse. If we grant a refund, you do not acquire or keep ownership of the AI-generated content produced under that subscription, you must stop using it and delete any copies, and you agree that we may use that content. This voluntary guarantee is in addition to any statutory withdrawal or consumer rights, which remain unaffected.

5. Acceptable use

You agree not to use the service to create, store, or distribute content that is unlawful, infringing, defamatory, hateful, or that depicts the sexual exploitation of minors, and not to: reverse engineer or disrupt the service; bypass usage limits; use automated means to abuse the service; or violate the rights of others or any applicable law. We may suspend or terminate accounts that breach these rules.

6. Your content and intellectual property

As between you and us, you retain rights in the inputs you provide. Subject to your compliance with these Terms and applicable law, we do not claim ownership of the output generated for you, and you may use it for your own purposes, including publication. You grant us the limited rights necessary to operate the service (for example, to store and process your content and transmit it to our AI providers to generate output).

Important note on copyright of AI output: the legal status of purely AI-generated content varies by country, and in some jurisdictions such content may not be protected by copyright or may require meaningful human authorship for protection. You are responsible for understanding the rules that apply to you. We make no representation that AI-generated output is protectable, original, or free of similarity to existing works.

7. Third-party platforms and no earnings guarantee

The service may provide research and guidance about third-party publishing platforms. We research this in good faith from public sources, but platform terms and AI-content policies change and may be inaccurate or outdated. You are solely responsible for complying with each platform's terms and AI-disclosure rules. We are not responsible for any action taken by a third-party platform, including account suspension, content removal, or withheld payment, and we are not affiliated with any platform.

No earnings guarantee. We do not promise or guarantee any income, sales, readership, or results from using the service. Any figures shown are reported ranges from third-party or platform sources, often describe exceptional cases, and are not typical. Most authors earn little or nothing.

8. Disclaimer of warranties

To the extent permitted by law, the service and all output are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation. Mandatory statutory warranty rights for consumers remain unaffected.

9. Limitation of liability

We are liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body, or health, under the German Product Liability Act, and to the extent we have assumed a guarantee. For slightly negligent breaches of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded. This Section does not limit any mandatory statutory liability.

10. Indemnification

To the extent permitted by law, you agree to release us from third-party claims arising out of your unlawful use of the service or your breach of these Terms, including content you create, store, or publish using the service.

11. Suspension and termination

You may stop using the service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms, if required by law, or to protect the service or other users. Statutory rights of termination for good cause remain unaffected. On termination, your right to use the service ends; provisions that by their nature should survive will survive.

12. Changes to the service and these Terms

We may modify the service and update these Terms. We will provide reasonable notice of material changes that disadvantage you, for example by email or in the application, and, where required, give you the opportunity to object or terminate before the change takes effect.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence. The statutory place of jurisdiction applies.

14. Final provisions

If any provision of these Terms is or becomes invalid, the remaining provisions remain unaffected. These Terms, together with the Privacy Policy and the Cancellation and Refunds page, constitute the agreement between you and us regarding the service.
